These Terms of Service ("Terms") govern your use of the Swistly mobile application ("Swistly", "we", "us"). By creating an account or using the app you agree to these Terms.

1. Account & Use

You must provide accurate information at signup, including a valid email address and mobile phone number. You are responsible for all activity under your account.

2. Acceptable Use

Don't use Swistly to store unlawful content, attempt to disrupt the service, reverse-engineer the app, or attempt to access other users' data.

3. SMS Messaging Program Terms

Program description. When you opt in at signup, Swistly may send you SMS text messages related to your account — including account notifications, service updates, and occasional product news.

Opt-in is voluntary. SMS messages are optional. Opting in is not a condition of creating or using your Swistly account. You can use every feature of the app without ever consenting to SMS.

Message frequency. Message frequency varies based on activity.

Message and data rates. Msg & data rates may apply, depending on your mobile carrier and plan.

STOP. You can cancel SMS messages at any time by replying STOP to any message we send. After you reply STOP, we'll send a one-time confirmation that you have been unsubscribed and we will not send you any further messages. To resubscribe, sign up again from within the app.

HELP. For help at any time, reply HELP to any message we send, or contact us at the email below.

Carrier disclaimer. Carriers are not liable for delayed or undelivered messages. Supported carriers include AT&T, Verizon, T-Mobile, Sprint, U.S. Cellular, and other major U.S. carriers. Service may not be available on all carriers.

4. Your Content

You retain ownership of the notes, transcripts, and audio you create. You grant Swistly a limited license to store and process that content to provide the service to you (e.g. transcription, organisation, search).

5. Termination

You can delete your account at any time from the app's Settings screen. We may suspend or terminate accounts that violate these Terms.

6. Disclaimers & Limitation of Liability

Swistly is provided "as is" without warranties of any kind. To the maximum extent permitted by law, Swistly is not liable for indirect, incidental, or consequential damages arising from your use of the service.

7. Changes

We may update these Terms. Material changes will require you to re-accept the new version inside the app before continuing to use it.
